On Thursday, November 21, 2013, Kolsby Gordon attorneys James E. Foerstner and Prince Holloway won a jury verdict in the amount of $850,000 on behalf of two clients.
A woman lost partial functioning of her left arm as a result of an injury to her ulnar nerve, and argued that the nerve was negligently severed by her surgeon during an operation to drain an abscess in the vicinity of the nerve.
Initially, the surgeon denied injuring the nerve and blamed the damage on an unforeseeable post-operative infection. Yet Mr. Foerstner and Mr. Holloway developed such a strong case on behalf of their clients that the defendants admitted liability the day before trial and the case was tried on damages.
After four days of trial in the Philadelphia Court of Common Pleas, the jury returned with a unanimous verdict of $850,000.
