On November 20, 2013, Kolsby Gordon attorney Robert N. Hunn was a featured speaker at the National Business Institute seminar, “Advanced Issues in Personal Injury Litigation.”
As part of this all-day seminar in Philadelphia, Mr. Hunn spoke to a group of attorneys about innovative ways in which medical records can be used to win at trial or during arbitration.
Many lawyers simply move their client’s medical records into evidence at trial under the false belief that somehow the information contained therein will transfer into the jury’s brain through osmosis. Mr. Hunn discussed various techniques for better explaining to the jury the information contained within medical records. Additionally, Mr. Hunn spoke about techniques for using medical records to boost the credibility of a case.
Medical records play a vital role in personal injury cases. Because compensation in these types of cases is based on the degree of injury and pain and suffering, it is far more effective to prove injury and damages through what is written in the medical records than through testimony from the plaintiff—which a jury can view as self-serving.
